Basic seminar on public procurement law (online seminar)

Get a comprehensive overview of the structure of European and national public procurement law.

Public sector supply, service and construction contracts represent a significant economic factor. According to estimates by the Commission of the European Union, the business volume of public contracts in the European Communities is worth 1.5 trillion euros annually - that is 16% of the total gross domestic product of the EU. At the intersection of budgetary law and competition law, public procurement law regulates the procedure to be followed and the material criteria according to which the public sector selects the contractor. The participants will gain an overview of this complex legal matter and will be able to master the basic features of a procurement procedure on both the client and the contractor side and to know its course.

The seminar will provide participants with a comprehensive overview of the structure of European and national public procurement law. In addition, the participants will have the opportunity to address and deepen individual questions relevant to practice. The theoretical knowledge imparted will be deepened by working on cases from practice.

Contents The lecture is oriented towards the course of a public procurement procedure. In this respect, a differentiation is made between procedures at national level and Europe-wide award procedures. The legal bases from the budget law as well as the competition law in connection with the relevant European law defaults are presented. Typical errors in award procedures are described on the basis of concrete practical cases. Legal protection possibilities of the bidders and the expiration of a review procedure before the assignment chambers and/or - senates are explained. A further topic is claims for damages by unsuccessful bidders in the event of a breach of procurement rules by the body issuing the invitation to tender. Finally, the relations under the law of obligations which exist between the parties after the award of the contract are discussed.

Target group The seminar is aimed at lawyers, economists and engineers as well as employees in public administration and persons entrusted with procurement/awarding.

Certificate of Participation/Completion All participants will receive a certificate of participation. There is also the possibility of completing the course with a university certificate by passing an examination in the form of a written exam.
