Statutory compensation for inventors

In the case of an employee invention, the employee is entitled to appropriate compensation. The Employee Inventions Act (ArbNErfG) applies to inventions and patents at the Brandenburg University of Technology (BTU) Cottbus-Senftenberg. Under the guidelines for universities set out therein, inventors are entitled to 30% of the gross revenue generated by the BTU through the exploitation
(e.g. licensing or sale) of the invention.

Furthermore, performance-based funding allocation (LOM) at BTU Cottbus-Senftenberg is regulated, amongst other things, by the ‘PersLOM’ model. Patents and technology transfer are included here as measurable achievements.

Allocation model (PersLOM) at BTU:

The assessment of performance-related pay for academic staff is based on four parameter groups (teaching, research, promotion of young researchers and organisation). Fixed point values apply to patents and commercialisation:

  • Patents (initial application or grant): These are awarded 50 points in the technology transfer category.
  • Participation in spin-offs: Awarded 40 points.

Further details on the exact points allocation and the requirements can be found in the BTU’s University Performance-Related Remuneration Regulations, or please contact us.
