Software usage policy
Ordering licensed software
By ordering software, the licensee agrees to comply with the licence terms. The user is responsible for informing themselves about the specific licence terms for the software. The procurement of licensed software for commercial use is prohibited.
Compliance with licence terms
Regardless of whether the order has been signed, the head of the institution is responsible for compliance with the licence terms in the institution's facilities. They are obliged to monitor the use of the software. It is sufficient for this purpose to display the relevant rules in publicly accessible computer rooms, for example, and to have users acknowledge the relevant rules of use by signing them.
Purchase of licensed software
The purchaser becomes the owner of the licensed software after full payment of all costs.
Rental of licensed software
In the case of a temporary transfer of software licences, the purchaser does not become the owner, but only the user of the licences for a specified period of use.
Upon expiry of this period, the purchaser is obliged to destroy all copies of the software and to cease using the software without prior request.
Provision of licensed software by IT Services
IT Services manages software licences to a certain extent. When data carriers are provided, the user is bound by the copyright provisions.
Licensed software stored in the computer centre, its data carriers or the access data for downloading the software shall only be handed over to the person responsible for software at the BTU Cottbus-Senftenberg or a person authorised by him.
The handover shall take place upon presentation of the service ID card and the licence invoice for the corresponding software.
Passwords that enable access to licensed software must be treated as strictly confidential.
Data carriers for installing licensed software will only be loaned by the computer centre in exceptional cases. They may not be passed on to third parties.
Use of freely accessible software from the FTP server
The use of freely accessible software from the FTP server is permitted to all members of the BTU Cottbus-Senftenberg in compliance with the respective licence conditions.
Use of licensed software
A licence for the product must be purchased for each computer on which a product is ‘in use’. A product is considered ‘in use’ if it is installed ‘locally’ on the hard drive of the computer or loaded into the computer's RAM. The latter is the case whenever a program is called up.
In networks, suitable measures (e.g. control software or an appropriate number of licences) must be taken to ensure that no more than the licensed number of programme calls can be made at any one time.
The conditions for the private use of licences acquired for business purposes are set out in the licence terms and conditions of the respective product.
If any of the rules listed here contradict the terms and conditions of the licensor, the latter shall apply.
Editing licensed software
The licensee is not entitled to decompile, disassemble, imitate or manufacture products derived from the software.
Copying licensed software
Any copying of software – except for backup purposes – is prohibited.
The licensee is not entitled to rent, lend, sell or otherwise transfer the licensed software without the prior written consent of the licensor.
The production of ‘pirated copies’ and their distribution, as well as any violation of the above provisions, will result in appropriate legal action.
Backup copies must be labelled correctly (indicating copyright or property rights). Upon termination of the licence agreement, all copies of the software must be returned or destroyed immediately and this must be confirmed in writing to the Cottbus Computer Centre.
Transfer of licensed software
The transfer of software and documentation to third parties is not permitted.
The licensee is obliged to comply with the statutory provisions such as copyright protection and copyright.
Prices for licensed software published in the Software Service System
The price lists published by the Cottbus Computer Centre in the Software Service area are for the information of users. The prices listed therein are subject to price changes and errors.
Non-compliance with payment obligations
If the licensee fails to meet their payment obligations entered into in connection with the acquisition of a licence via IT Services, IT Services reserves the right, without prejudice to claims for damages, to exclude the licensee from further purchases of software via the computer centre.
Violation of the above licence conditions
Any breach by the licensee of the terms and conditions set out herein may result in the licensee losing their licence without compensation and being excluded from obtaining software via the computer centre, without prejudice to any claims for damages and legal action by the licensor.
